ProctorEye, LLC ("ProctorEye," "we," "us," or "our") is committed to protecting the privacy of its users, especially students and educators. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our ProctorEye Chrome extension and associated dashboard services (collectively, the "Service"). This policy applies to users in the United States.

1. Information We Collect

We may collect information about you in a variety of ways. The information we may collect via the Service depends on the content and materials you use, and includes:

  • School/District Provided Information: We may collect information provided by your school or district, such as student rosters, class information, and teacher information, to set up and manage the Service.
  • Usage Data (via Chrome Extension during active sessions): When the ProctorEye extension is active during a monitored session (as initiated by a teacher or administrator), we may collect information about your browser activity, such as:
    • Websites visited (tab tracking)
    • Clipboard events (copy/paste actions)
    • Browser tab focus and idle time
    • Screenshots or screen recordings (for "Standard" and "Pro" features, if and when available and enabled by the school/district)
  • Dashboard Activity: We collect information about how teachers and administrators interact with the dashboard, such as features used and reports generated.
  • Device Information: We may collect basic information about the device used to access the Service (e.g., operating system, browser type) for functionality and security purposes. We do not collect personal files or unrelated browsing history.

We are a service provider to schools and districts. Our collection and use of student data are governed by our agreements with these educational institutions and applicable laws such as FERPA (Family Educational Rights and Privacy Act) and COPPA (Children's Online Privacy Protection Act).

2. How We Use Your Information

Having accurate information permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the Service to:

  • Provide, operate, and maintain our Service.
  • Enable teachers and administrators to monitor student activity during designated class or test sessions.
  • Generate reports and analytics for educational purposes as directed by the school/district.
  • Improve our Service and develop new features.
  • Ensure the security and integrity of our Service.
  • Comply with legal obligations and agreements with educational institutions.
  • Respond to your comments, questions, and provide customer support.

3. Disclosure of Your Information

We do not sell student personal information. We may share information we have collected about you in certain situations. Your information may be disclosed as follows:

  • By Law or to Protect Rights: If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation.
  • Service Providers: We may share your information with third-party vendors, service contractors, and other third parties who perform services for us or on our behalf and require access to such information to do that work (e.g., cloud hosting). These service providers are contractually obligated to protect your data.
  • Educational Institutions: Information collected is primarily for the use of the subscribing school or district and will be accessible to authorized personnel (teachers, administrators) within that institution.
  • Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. We will notify you and the educational institution before your personal information is transferred and becomes subject to a different privacy policy.

4. Data Security

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse.

5. Data Retention

We will retain student personal information for only as long as is necessary to fulfill the purposes for which it was collected, as required by our agreement with the educational institution, or as required by law. Data is typically deleted upon request from the school/district or at the end of a contract.

6. Student Privacy and COPPA

We are committed to complying with COPPA. We rely on the school or district to obtain any necessary parental consent for students under 13 to use the Service. If you believe we have inadvertently collected information from a child under 13 without proper consent, please contact us immediately.

7. Your Rights (FERPA)

If you are a parent or student, you may have certain rights regarding your personal information under FERPA. Please contact your educational institution to exercise these rights. We will work with them to support their obligations under FERPA.

8. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date. We encourage you to review this Privacy Policy periodically for any changes.
